1. Agreement to Terms

Welcome to Destara AI. These Terms of Service ("Terms") constitute a legally binding agreement between you ("you," "your," or "User") and Destara AI ("Destara," "we," "our," or "us") governing your access to and use of the Destara progressive web application, available at destaraai.lovable.app, including all features, content, AI tools, downloadable reports, and related services (collectively, the "Service").

By creating an account, accessing, or using the Service in any way, you confirm that you:

• Are at least 13 years of age (or 16 in the European Economic Area)
• Have read, understood, and agree to be bound by these Terms
• Have read and agree to our Privacy Policy, incorporated herein by reference

If you do not agree to these Terms, you must immediately stop using the Service. If you are using the Service on behalf of an organisation, you represent that you have the authority to bind that organisation to these Terms.

2. Description of Service

Destara is a mobile-first progressive web application (PWA) that delivers personalised Chinese astrology, Feng Shui guidance, and lifestyle coaching through an AI-powered platform. Core features include:

• Cosmic Profile Calculation — Chinese zodiac, ruling element, Yin/Yang polarity, and KUA number derived from your birth data
• AI-Generated Forecasts — Daily, weekly, monthly, and yearly personalised astrological guidance
• Destiny Mentor — An AI conversational assistant specialising in Chinese metaphysics (available on Ultimate tier and above)
• Feng Shui Compass — Directional guidance tool using device sensors and your personal KUA number
• Chinese Almanac — Interactive Tung Shing calendar with auspicious date planning
• Zodiac Compatibility — Compatibility analysis between Chinese zodiac signs
• Destiny Reports — Downloadable PDF reports containing personalised zodiac and Feng Shui analyses
• Photo Booth — Camera feature with Chinese New Year themed frames
• Wishing Papers — A digital recreation of traditional wish-burning rituals
• AI Support Assistant — First-line customer support chatbot with human escalation

The Service is designed exclusively for mobile viewports. Access via desktop browsers may be restricted or blocked.

3. Accounts and Registration

3.1 Eligibility

You must be at least 13 years old to create an account. Users in the EEA must be at least 16. By registering, you represent that you meet the applicable age requirement. If we discover that a user is underage, we reserve the right to immediately terminate their account.

3.2 Account Creation

You may register using:

• An email address and password
• A phone number with OTP (one-time password) verification

You agree to provide accurate, current, and complete information during registration and to keep your account information updated at all times.

3.3 Account Security

You are responsible for:

• Maintaining the confidentiality of your login credentials
• All activity that occurs under your account
• Notifying us immediately at support@destara.ai if you suspect unauthorised access

We will not be liable for any loss or damage arising from your failure to protect your account credentials.

3.4 One Account Per User

You may only maintain one active account. Creating multiple accounts to circumvent restrictions, extend trial periods, or abuse the Service is prohibited and may result in the termination of all associated accounts.

3.5 Account Verification

Email verification is required before accessing the full Service. We reserve the right to suspend unverified accounts.

4. Subscription Tiers and Billing

4.2 Trial Period

New accounts may be granted a 3-day full-access Trial. The Trial expires automatically and access is downgraded to Free tier at the end of the Trial period. No credit card is required to begin a Trial. Trial periods may not be extended, repeated, or transferred.

4.3 Paid Subscriptions

• Subscriptions are billed in advance on a recurring basis (monthly or annually, as selected)
• Payment is processed via our third-party payment processor
• By subscribing, you authorise us to charge your payment method on a recurring basis until you cancel
• Prices are displayed in the App and may vary by region. We reserve the right to change pricing with 30 days' notice

4.4 Cancellation

You may cancel your subscription at any time via your account settings. Cancellation takes effect at the end of the current billing period. You will retain access to paid features until the period ends. We do not pro-rate or refund partial billing periods.

4.5 Refunds

All purchases are generally non-refundable. Exceptions may apply where required by applicable consumer protection law in your jurisdiction. To request a refund review, contact billing@destara.ai within 7 days of the charge.

4.6 Failed Payments

If a payment fails, we will attempt to retry the charge. If payment is not received within a reasonable period, your account will be downgraded to the Free tier until payment is resolved.

4.7 Premium-Locked Features

Features unavailable on your current tier are displayed with a frosted overlay and an upgrade prompt. Accessing, circumventing, or attempting to unlock premium features without a valid subscription is a violation of these Terms.

5. Acceptable Use Policy

You agree to use the Service only for lawful, personal, non-commercial purposes and in a manner consistent with these Terms. You agree not to:

5.1 Prohibited Conduct

• Use the Service if you are under the applicable minimum age
• Impersonate any person or entity, or falsely represent your affiliation with any person or entity
• Create accounts using false or misleading information
• Use the Service for any fraudulent, deceptive, or harmful purpose
• Harass, threaten, or abuse other users or Destara staff
• Attempt to gain unauthorised access to any part of the Service, other users' accounts, or our backend systems
• Reverse engineer, decompile, disassemble, or attempt to extract the source code of the Service
• Scrape, crawl, or systematically extract data from the Service using automated tools
• Upload, transmit, or share content that is unlawful, defamatory, obscene, or infringes any third-party rights
• Use the Service to send spam, unsolicited messages, or promotional content to other users
• Interfere with or disrupt the integrity or performance of the Service or its servers
• Circumvent, disable, or interfere with any security-related feature of the Service
• Use the Service to develop a competing product or service

5.2 AI Feature Conduct (Destiny Mentor)

When using the Destiny Mentor AI or any other AI-powered feature, you additionally agree not to:

• Attempt to manipulate, jailbreak, or override the AI's safety guidelines or system instructions
• Submit inputs designed to generate harmful, offensive, or illegal content
• Use AI outputs for professional advice (medical, legal, financial, psychological) without independent verification
• Rely on AI-generated content as a substitute for qualified professional consultation

5.3 Content Standards

Any content you submit — including messages, photos, calendar entries, and survey responses — must not:

• Contain hate speech, discrimination, or incitement to violence
• Depict or promote self-harm, abuse, or exploitation of minors
• Infringe any intellectual property, privacy, or publicity right
• Contain profanity or sexually explicit material (our platform applies automated profanity filtering)

We reserve the right to remove any content that violates these standards without prior notice.

6. Intellectual Property

6.1 Our Intellectual Property

All content within the Service — including but not limited to the Destara name, logo, design system, UI, source code, AI models, astrological calculation algorithms, written content, imagery, animations, and reports — is owned by or licensed to Destara AI and is protected by applicable copyright, trademark, and intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable licence to access and use the Service for your personal, non-commercial purposes. This licence does not include the right to:

• Copy, modify, or create derivative works from the Service
• Redistribute, sell, or sublicense any part of the Service
• Remove or alter any proprietary notices

6.2 Your Content

You retain ownership of content you submit to the Service (e.g., messages to the Destiny Mentor, compass photos, calendar entries). By submitting content, you grant Destara a limited, worldwide, royalty-free licence to host, store, process, and display that content solely for the purpose of providing the Service to you.

We do not use your personal content to train AI models.

6.3 Feedback

If you submit feedback, suggestions, or ideas about the Service, you grant us the right to use them freely without compensation or attribution.

7. AI-Generated Content — Disclaimer

Destara makes no representations or warranties regarding the accuracy, reliability, or fitness for any particular purpose of AI-generated content. You agree to use all astrological, metaphysical, and AI-generated content at your own discretion and risk.

8. Third-Party Services and Links

The Service integrates with and relies upon third-party services including Google (Gemini AI, Firebase, reCAPTCHA), Supabase, and others. Your use of these integrated services is subject to their respective terms of service and privacy policies. Destara is not responsible for the practices, content, or availability of any third-party service.

The Service may contain links to external websites or content not operated by Destara. We do not endorse and are not responsible for any third-party content or websites.

9. Availability and Modifications

9.1 Service Availability

We strive to maintain a reliable and available Service but do not guarantee uninterrupted, error-free, or secure access. The Service may be temporarily unavailable due to scheduled maintenance, unplanned outages, or circumstances beyond our control.

9.2 Modifications to the Service

We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice. This includes changing features, subscription pricing, tier access levels, or AI capabilities. We will endeavour to provide reasonable advance notice of material changes.

9.3 Modifications to These Terms

We may update these Terms at any time. When we make material changes, we will update the "Last Updated" date, notify you via in-app notice, and, for significant changes, send an email to your registered address. Your continued use of the Service after the effective date of any revision constitutes your acceptance of the revised Terms.

10. Termination

10.1 Termination by You

You may stop using the Service and delete your account at any time through your account settings. Account deletion will remove your personal data in accordance with our Privacy Policy.

10.2 Termination by Destara

We reserve the right to suspend or permanently terminate your account, with or without notice, if we determine in our sole discretion that you have:

• Violated any provision of these Terms
• Engaged in fraudulent, abusive, or harmful conduct
• Failed to pay subscription fees when due
• Created multiple accounts to circumvent restrictions
• Posed a security or legal risk to the Service or other users

Upon termination, your right to use the Service ceases immediately. Provisions of these Terms that by their nature should survive termination will do so, including Sections 6, 7, 11, 12, and 13.

11. Disclaimers

Some jurisdictions do not allow the exclusion of certain warranties, so some of the above exclusions may not apply to you.

12. Limitation of Liability

These limitations apply regardless of the legal theory on which the claim is based, even if Destara has been advised of the possibility of such damages. Some jurisdictions do not allow limitations on liability for certain types of damages, so some of the above limitations may not apply to you.

13. Indemnification

You agree to indemnify, defend, and hold harmless Destara AI and its officers, directors, employees, agents, and licensors from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or relating to:

• Your use of or access to the Service
• Your violation of these Terms
• Your violation of any third-party rights, including intellectual property or privacy rights
• Any content you submit through the Service

14. Governing Law and Dispute Resolution

14.1 Governing Law

These Terms shall be governed by and construed in accordance with applicable law. Where you access the Service from the Philippines, these Terms are governed by the laws of the Republic of the Philippines. Where you access the Service from the EEA or UK, applicable EU and UK consumer protection laws apply alongside these Terms and may provide you with additional rights.

14.2 Informal Resolution

We encourage you to contact us first at support@destara.ai to resolve any dispute informally. We will make a good-faith effort to resolve your concern within 30 days.

14.3 Formal Dispute Resolution

If informal resolution fails, disputes shall be resolved through binding arbitration or the courts of competent jurisdiction applicable to your region. Nothing in this section prevents either party from seeking injunctive or other equitable relief in a court of competent jurisdiction to prevent the actual or threatened infringement of intellectual property rights.

14.4 Class Action Waiver

To the extent permitted by law, you agree to resolve disputes with Destara on an individual basis only, and waive any right to participate in a class action lawsuit or class-wide arbitration.

15. Special Provisions by Region

15.1 European Economic Area and United Kingdom

If you are located in the EEA or UK, nothing in these Terms limits your statutory rights as a consumer under applicable EU or UK law. In the event of any conflict between these Terms and your statutory rights, your statutory rights shall prevail.

15.2 Philippines

If you are located in the Philippines, your rights under the Consumer Act of the Philippines (Republic Act No. 7394) and the Data Privacy Act of 2012 (Republic Act No. 10173) are not waived by these Terms.

15.3 California

If you are a California resident, you have certain rights under the California Consumer Privacy Act (CCPA) and California Consumer Protection laws. Please refer to our Privacy Policy for details.

16. Miscellaneous
